The recently amended Federal Rules of Civil Procedure (FRCP) regarding electronic discovery have raised the stakes with respect to the duty parties to federal civil proceedings having to preserve and protect all forms of electronic data. Companies that are parties to a litigation matter, or become aware of the potential for claims to be asserted, now also have a duty to institute steps to preserve and protect all relevant data that may be subject to discovery, including taking steps to preclude evidence from being destroyed.
