The Clean Development Mechanism (CDM), introduced
through Article 12 of the Kyoto Protocol, reflects
the global dimension of Climate Change and is gaining
momentum. Certified Emission Reductions (CERs) are
being traded all over Europe and, in addition, in
more and more other regions of the world too. The
study provides an overview on all legal aspects that
are to be considered when trading CERs: it starts
with a description of the legal framework set by the
Kyoto Protocol and its succeeding accords, thereby
illustrating the key issues for generation of CERs
through CDM projects and it describes the present
legal framework within the European Union as well as
within Switzerland. It covers both regulatory issues
such as compliance, linking of systems or voluntary
markets as well as contractual aspects. It ends with
an outline of policy making issues and an outlook on
the post-Kyoto period. The study is addressed to
scholars, practitioners (such as CDM investors or
managers of installations that have to comply with an
Emission Trading Scheme) and policy makers.
