China offers many challenges to companies. The most severe problem is the effective protection of intellectual property rights (IPR). Yet, this issue is of fundamental relevance for every manager as it usually protects the core competences and competitive advantages of the company. Hence, it is not sufficient to see this challenge only as a legal issue and to delegate IPR issues to legal departments or legal advisors. The critical aspect of IPR protection in China needs to managed from two sides – legal and factual. With the improvement of the Chinese legal system each of these two aspects should be in focus of attention of executives operating in China.
