BULLETIN: Kansas Court Reverses Parts Of Westar's Rate Order; No Effect On Rating Jul 06

Abstract NEW YORK (Standard & Poor's) July 10, 2006--Standard & Poor's Ratings Services said today that the Kansas Court of Appeals rejection of parts of the Kansas Corporation Commission's (KCC) December 2005 rate order for Westar Energy Inc. (BB+/Positive/--) does not immediately affect the company's ratings or positive outlook. However, if reconsideration leads to a material rate reduction or customer refund, upside credit potential for Westar could be limited. The concerns raised focus on transmission delivery charges, recovery of terminal net salvage in depreciation rates, and other technical issues. The issues remanded to the KCC can be resolved through a proceeding before the KCC or the various parties, including Westar, the KCC, and consumer advocates, can appeal to the Kansas Supreme...
