This unique, illuminating book presents a critical reflection on the unification of international trade law. It identifies the principles that underpin the current move towards the unification, then working from the gaps identified in these principles it presents the basis for a further perspective on unification, one that seeks to situate unification in relation to what the author terms a second modernity of the contemporary world. In developing this theme, the author pays particular attention to Martti Koskenniemis method of regressive analysis – which examines in detail the origins of international law – through liberal political theory. He also examines lex mercatoria, specifically its relationship to state law and what is termed intermediate law as established by conventions such as the UNIDROIT Principles for International Commercial Law.
