The litigation funding market in the UK is still in its infancy, but there are signs that it is starting to move into the mainstream. Factors such as the spiralling costs of litigation, the spread of litigation funding options to smaller companies, and a growing interest in the market from investors looking for new investment opportunities are likely to boost growth. The UK is one of the largest litigation markets in the world so this country will become a focus for future growth.

So far, the market has been dominated by large commercial claim funding but the market is diversifying. Over the last few months in the UK, we have seen the launch of new litigation funders, or new funding packages from existing players aimed at funding smaller value commercial claims, i.e. £100,000 or even £50,000. There are also funders looking to explore opportunities to support mass action consumer claims and private litigation involving high net worth individuals. Divorce financing, in particular, could become a niche area for funders.

The Litigation Funding in the UK 2015 provides: an overview of the UK litigation funding market; profiles of the major funders; market drivers and obstacles; SWOT analysis; high profile cases; market outlook. Litigation funding, sometimes referred to as third-party funding, is where a third party provides the financial resources to enable costly litigation or arbitration cases to proceed.
