The Tobacco and Related Products Act (Tobacco Products Act or TabakerzG) came into force on 20th May 2016, bringing the EU’s Tobacco Products Directive (TPD) framework into German law, including the regulation of e-cigarettes as tobacco-related products. This report provides an overview of the current regulatory regime.

At the same time, a complementary regulation came into force providing more specific guidance: the Tobacco and Related Products Ordinance (Tobacco Products Ordinance or TabakerzV).

With the adoption of the Second Law amending the Tobacco Products Act, the definition of e-cigarettes and refill containers was amended to include also those without nicotine. The term “refill container” under Article 1 (1) of the amended Tobacco Products Act refers to a container that contains liquid used for refilling an electronic cigarette.
