So much of a criminal lawyer’s work in negotiating a plea takes place behind the desk, on the phone, and in the hallways, rather than in the courtroom. Even when defense counsel and the prosecutor do not agree, a rich presentation when negotiating a plea lays the groundwork for effective sentencing advocacy. This program acquaints new and experienced practitioners with information on effective plea bargaining in the District/Municipal Courts and Superior Courts. The experienced panel walks attendees through, among other topics, relevant law pertaining to pleas, alternate disposition such as pretrial probation, crafting compelling written submissions, creative strategies to reach agreement, and using experts and other resources to persuade.
