Cannabis in the Insolvency World: Learn about issues that arise when individuals and business involved in state-sanctioned, but federally illegal, cannabis businesses encounter insolvency. The panel discusses the federal statutory scheme governing cannabis, its tension with state laws, and developing case law regarding roadblocks in accessing relief under the Bankruptcy Code. The panel also analyzes state court receiverships and other non-bankruptcy methods for dealing with cannabis related businesses, and special concerns that lenders and other parties should address in dealing with those in the industry.

Thorny Lien Issues: Hear about a variety of issues in avoiding non-consensual liens. Get updated on recent decisions regarding judicial lien avoidance, including valuing a debtor’s interest in property and asymmetrical debt obligations, and potential strategies for debtors and creditors. Learn about condominium lien issues and changes to the Massachusetts homestead statute.

Chapter 13 Issues (Sounds Like a Plan, But Maybe Not): Get updated on the rapidly changing case law surrounding Chapter 13 plans. What is an acceptable plan term before a sale or mortgage modification occurs and what happens until the sale is completed? What contributions, if any, may a Chapter 13 debtor make to a retirement account during the plan term and what factors inform the court’s decision-making process when evaluating these contributions?

  • A provision in a subordination agreement between two sophisticated creditors authorizing the senior creditor to vote the claim of the junior creditor in any bankruptcy filed by their common debtor should be enforced by the Bankruptcy Court, or should it?
