The Americans with Disabilities Act created rights and responsibilities for property owners, property managers, applicants, and tenants in connection with access to housing. Together with Massachusetts laws and regulations which prohibit discrimination based upon disability, this Act has created a number of challenging issues for attorneys and their clients-complicated by the reality that each scenario has vastly different factual considerations, which make easy resolution difficult.
Questions of responsibility and liability based upon reasonable accommodations occur at all stages in the landlord-tenant relationship-from the application to the termination of the tenancy, including those raised on the eve of eviction.
This focused program guides you through the basics of this area of law, and features a discussion of common pitfalls in asserting and responding to requests for accommodation, medical and social services resources available to parties, and alternative uses of reasonable accommodation concepts-both prior to and during court action.
