Everyone is aware that the National Labor Relations Board (NLRB) has been actively hunting down employers with policies and practices that appear to create a “chilling effect” on their employees’ right under the National Labor Relations Act (NLRA). What too many employers don’t realize, however, is that the NLRB doesn’t draw distinctions between employers with unions and those without.The NLRB has been on the hunt for non-unionized employers who appear to be oppressing employees’ rights as to the terms and conditions of their employment. As a result, the NLRB has been scrutinizing and condemning employers’ policies, such as at-will statements, social media policies, employee investigations, use of employer communications, and a host of other rules. Luckily, the NLRB has recently issued a memorandum which assists us in managing the hurdles set by the NLRB.
